Agreement:

This agreement constitutes the complete and comprehensive understanding between the client and us, replacing any previous or concurrent agreements between the involved parties. Modifications or additions to this agreement must be made in writing through email or direct message and require the signatures of all parties involved. Should any portion of this agreement be deemed unenforceable or invalid, the rest of the agreement will still hold its legal force. Any decision to forgo specific terms within this agreement or the failure to enforce them by either or both parties will not be interpreted as a relinquishment of any other aspects or terms outlined in this agreement.

This agreement takes effect between Nebulous Video Production's client and Sam Eastwood t/a Nebulous Video Production.

Schedule:

The client commits to finalising the schedule no later than one month before the event(s). Any alterations to the schedule or venue must be communicated promptly, and you should ensure that we acknowledge receipt of such changes.

Payment Terms:

The prices quoted by Nebulous Video Production are based on the specific services and deliverables outlined in the proposal provided to the Client. All quotations are valid for a period of 28 days from the date of issuance.

Payment shall be made according to the following schedule:

Upon acceptance of the quote provided, the couple agrees to a deposit of 25% of the total cost to initiate the wedding project.

9 months (270 days) from the wedding day, the Couple agrees to pay 50% of the total cost of the wedding.

The final 25% of the wedding project is due no later than 30 days before the wedding.

Staff Safety:

We maintain the right to cease coverage and depart from the event location if the Videographer(s) encounter inappropriate, threatening, hostile, or offensive conduct from any individual(s) present; or if the safety of the Videographer(s) becomes a concern.

For our protection and that of the client, we possess personal liability insurance to cover unexpected occurrences that result in harm to our equipment. You will not be held responsible for any expenses arising from equipment damage during event filming unless the damage is intentionally caused with the intent to harm the equipment.

Travel:

All travel expenses are based on the distance between the event location(s) and our starting address BB3.

Premium Coverage - Travel expenses for weddings with Nebulous Video Production are NOT included with the Premium Coverage package. Details for travel costs will be outlined in the agreement with clients before any work is approved to make everyone aware and will be charged at Nebulous Video Production's rate of 50p per mile.

Excelsior Coverage - Travel expenses for weddings with Nebulous Video Production are only included in the price within a 30-mile radius of where our team travels from. Details for travel costs will be outlined in the agreement with clients before any work is approved to make everyone aware and will be charged at Nebulous Video Production's rate of 50p per mile.

Nebulous Coverage - Travel expenses for weddings with Nebulous Video Production are only included in the price within a 50-mile radius of where our team travels from. Details for travel costs will be outlined in the agreement with clients before any work is approved to make everyone aware and will be charged at Nebulous Video Production's rate of 50p per mile.

Duties:

We cannot be held accountable for compromised coverage resulting from factors beyond our control, including, but not limited to, disruptive guests, client or guest delays, weather-related issues, scheduling complexities, inaccurate addresses provided, decoration rendering, or location restrictions. Similarly, we are not liable for unfavorable backgrounds or lighting conditions that might impede or limit the quality of video or photo coverage.

Any specific events not included in your video and/or footage will not be our responsibility unless explicitly outlined during the pre-wedding meeting and subsequently requested.

Liability Limit:

In the rare circumstance that our assigned videographer is unable to fulfill the terms of this contract due to unforeseen circumstances such as injury, illness, acts of nature, acts of terrorism, or other uncontrollable factors, we will exert all efforts to secure a suitable replacement. Should this situation arise and a suitable replacement cannot be found, our responsibility and liability will be confined to reimbursing all payments received for the event, including any non-refundable deposits.

In the unlikely event that digital files are lost, stolen, or damaged due to causes beyond our control, encompassing camera malfunctions, hard drive issues, or equipment failures, our liability will be limited to refunding all payments received for the event(s). The maximum liability for a partial loss of original files will be calculated proportionally based on the percentage of total exposures lost. We cannot be held liable for the loss of images beyond what is lesser in value: the final delivery of all products included in the chosen package.

Post Production:

The client acknowledges that the ultimate decisions regarding post-production, editing styles, effects, and the overall visual appearance of the videos rest within our discretion.

Usage and Copyright Release:

The client grants us irrevocable and unrestricted permission to utilize and publish videography featuring the client or including the client, for purposes such as editorial content, trade, advertising, education, and any other relevant intention, across various mediums and platforms. This includes the freedom to modify the content without limitations and to secure copyright for it. The client renounces all rights to any potential profits resulting from the utilization of the videography.

Delivery:

As previously mentioned on our wedding page you will be delivered a USB with the following on it (only applicable for clients on the Nebulous Coverage package):

• Up to 8 minutes highlight film

• Full-length Ceremony Video

• Speeches

Any additional requests should be communicated during the pre-wedding meeting. We cannot be held responsible for any losses related to footage or coverage that hasn't been specifically requested.

In the event that any of the mentioned elements are absent on your wedding day (for example, if no cake is there to be cut), we will not provide substitute videos for these missing components.

Delivery of videos is estimated at around 5 weeks. This is subject to change and cannot be guaranteed and will sometimes be around 8 weeks.

The first Dance implementation is down to the editing style chosen and will result in a montage-style video with a mixture of slow-motion clips and regular speed clips. The song you choose for your first dance will be overlayed on top of the First Dance video we produce.

Cancellation:

For weddings and events, in the event that the Client decides to cancel up to 90 days prior to the wedding date, a refund of 80% of payments made will be issued, acknowledging the planning and administrative work that has been undertaken up to that point. Cancellation notices must be submitted in written form, either through mail or email. If the client wishes to reschedule the wedding date, we will make every effort to accommodate this change, with no additional charge, provided that the new date is both available and falls within three months of the original event date. Should Nebulous Video Production be unavailable on the new date, the initial contract will be canceled and subjected to the stipulated cancellation policy.

In the event of a cancellation of the wedding or videography package within 89 days of the event date, a payment of 50% of the total balance will be necessary to cover incurred damages, along with any associated legal fees if the matter escalates to court.

In the event of a cancellation of the wedding or videography package within 30 days of the event date, the full balance will be necessary to be paid in occurrence with Nebulous Video Production’s terms for weddings and events to be paid in full 30 days before the date of the event. The total balance will be necessary to cover incurred damages, along with any associated legal fees if the matter escalates to court.

If Nebulous Video Production is unable to fulfill this Contract due to reasons such as fire or other unforeseen incidents, a strike, natural disasters, or other uncontrollable circumstances beyond the control of both parties or if the Videographer is incapacitated due to illness or emergencies, the Videographer will refund 80% of the total fee, acknowledging the planning and administrative work that has been undertaken up to that point, to the Client and will not carry any further responsibility related to the Contract. This limitation on liability also holds true if video materials are impaired during processing, lost due to camera or other media malfunctions, misplaced in transit, or otherwise damaged or lost without any fault on the videographer's part.

Refund Policy:

Given the unique nature of digital videography, where videos, once provided, cannot be retrieved, Nebulous Video Production enforces a rigorous NO REFUNDS POLICY. Once a transaction is finalised (meaning the buyer has chosen and paid for the package, and Nebulous Video Production has correctly sent the buyer the designated videos), the purchase becomes non-refundable.

In the rare occurrence of legal action involving either party and a full refund being requested through a court of law, the client acknowledges that they will not retain any footage or deliverables from Nebulous Video Production. The client agrees to return all videos and/or footage within 30 days as part of this process.
